Terms and Conditions

Article 1: Scope and Amendment of These Terms and Conditions

1. Yumi Barker Cross-Cultural Marriage Counselling Room / Perth Japanese Counselling Room (hereinafter referred to as “the Counselling Room”) provides psychological counselling services (hereinafter referred to as “the Services”) to support users with psychological well-being and the resolution of personal issues.

2. The Counselling Room establishes these Terms and Conditions for the provision of the Services. These terms apply to all users, and by accessing this website or using the Services for any reason, users are deemed to have agreed to comply with these Terms and Conditions at their own responsibility.

3. Definitions:

   • “User” refers to any individual who accesses the website or receives the Services.

   • “The Services” refers to psychological counselling, email counselling, telephone/online counselling, and any other services provided by the Counselling Room. The specific details of the Services shall be determined by the Counselling Room.

Article 2: Disclaimer of Warranties and Limitation of Liability

1. The Counselling Room does not guarantee the absolute accuracy, completeness, or suitability of the information, articles, and content provided on this website or through the Services.

2. The Services are intended to provide psychological support, and users are solely responsible for any final decisions, actions, or outcomes based on the information provided. To the extent permitted by law, the Counselling Room shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of the Services.

3. The Counselling Room does not guarantee that this website, its servers, or any content or emails sent from the site are free of viruses or other harmful components, or free from unauthorised third-party access.

Article 3: Intellectual Property and Prohibition of Unauthorised Reproduction

1. All copyrights, trademarks, and other intellectual property rights in the text, data, articles, images, and programs on this website belong to the Counselling Room or their respective creators.

2. Users and viewers are strictly prohibited from reproducing, distributing, or modifying any content from this website on other sites, magazines, or advertisements without prior written permission from the Counselling Room. However, quoting or sharing articles on personal websites may be permitted with explicit prior consent from the Counselling Room.

3. In the event of unauthorised use or reproduction, the Counselling Room reserves the right to take legal action, including seeking injunctions and claims for damages under applicable copyright laws.

Article 4: Compensation for Damages

1. If a user causes damage to the Counselling Room, its business partners, or any third party due to a violation of these Terms and Conditions, applicable laws, or website regulations, the user shall be liable to compensate for all such damages at their own expense.

2. The user agrees to indemnify and hold harmless the Counselling Room from any claims, liabilities, or expenses arising from the user’s misuse of the Services or breach of these terms.

Article 5: Temporary Suspension or Termination of Services

The Counselling Room reserves the right to temporarily suspend or terminate the provision of the Services without prior notice for any of the following reasons. The Counselling Room shall not be held liable for any loss or damage incurred by users or third parties due to such suspension or termination:

1. If the user has provided false information or cannot be reached via the registered phone number or email address.

2. If services cannot be provided due to natural disasters, technical failures, or force majeure.

3. If the user violates these Terms and Conditions.

4. If the Counselling Room experiences operational, technical, or personal difficulties that make the provision of services impractical.

5. If a past violation of these terms by the user is discovered.

Article 6: Governing Law and Jurisdiction

1. In the event of any dispute arising out of or in connection with these Terms and Conditions or the Services, both parties agree to negotiate in good faith to reach an amicable resolution.

2. These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia.

3. If the dispute cannot be resolved through negotiation, both parties agree to submit to the exclusive jurisdiction of the courts of Western Australia.

Article 7: User Responsibilities and Communication Costs

1. Users are solely responsible for the content of all communications transmitted through the website or during the Services.

2. Users acknowledge that they are responsible for all internet connection fees, data charges, and communication costs required to access and use the Services.

3. The Counselling Room shall not be held responsible for any disadvantage or technical interruption experienced by the user due to their own internet environment or network instability.

Article 8: Changes to These Terms and Conditions

The Counselling Room may revise these Terms and Conditions at any time without prior notice. Users are responsible for reviewing this page regularly. Continued use of the Services following any modifications constitutes acceptance of the revised Terms and Conditions. The Counselling Room is not liable for any disadvantages caused by the user’s failure to check the updated terms.

Article 9: Cancellation Policy

Cancellations or appointment rescheduling made by the user on the day before or on the day of the scheduled appointment will incur a cancellation fee equal to 100% of the counselling fee.

Article 10: Refunds

Due to the nature of psychological counselling services, refunds cannot be provided once the service has been booked or rendered.

Article 11: Prohibited Conduct

When using the Services, users must not engage in any of the following activities:

1. Defaming, slandering, or abusing the counsellor.

2. Attempting to obtain the personal or private information of the counsellor.

3. Stalking, harassing, or threatening the counsellor’s safety, life, freedom, honour, or property.

4. Engaging in commercial or profit-making activities, such as selling goods or advertising to the counsellor.

5. Engaging in religious solicitation or recruiting the counsellor to join specific organisations.

6. Infringing upon the privacy, publicity rights, or intellectual property of the counsellor.

7. Engaging in conduct that damages the credibility, reputation, or operations of the Counselling Room.

8. Unauthorised access to the Counselling Room’s digital equipment, altering or deleting service-related data, or introducing computer viruses.

9. Any conduct that violates public order, morals, or applicable laws.

10. Meeting or contacting the counsellor for personal or private purposes outside of the professional Services.

Article 12: Miscellaneous (Medical Disclaimer and Minors)

1. The Services provided by the Counselling Room are psychological support and do not constitute medical acts, medical diagnosis, psychiatric examination, or clinical treatment. Therefore, medical insurance does not apply.

2. While the Services aim to support the resolution of psychological issues, the Counselling Room does not guarantee a complete or permanent resolution of all personal or psychological problems.

3. Minors (under the age of majority in their jurisdiction) require a signed consent form from a legal guardian to use the Services. The Counselling Room reserves the right to refuse service to minors even if a consent form is provided, if it is deemed inappropriate or difficult to proceed with the counselling.
