Article 1: Scope and Amendment of These Terms and Conditions
Yumi Barker Cross-Cultural marriage Counselling Room/Perth Japanese Counselling Room (hereinafter referred to as “the Counselling Room”) provides counselling services (hereinafter referred to as “the Services”) to assist users with psychological support and resolution of personal psychological issues.
The Counselling Room establishes these terms and conditions for providing the Services.
These terms and conditions apply between the users and the Counselling Room when using the Services, and users agree to comply with these terms and conditions at their own responsibility.
Furthermore, the Counselling Room considers users to have agreed to these terms and conditions upon accessing this site and using the Services, regardless of the reason.
The terms used in these terms and conditions are defined as follows:
1. “User” refers to a person who accesses the Counselling Room and receives counselling services.
2. “The Services” refers to psychological counselling, email counselling, telephone counselling, and other services provided by the Counselling Room in accordance with these terms and conditions. The details of the Services are determined by the Counselling Room.
Article 2: Disclaimer of Warranties
1. The Counselling Room does not guarantee the accuracy of the content of the Services and articles provided on this site. The Counselling Room is not liable for any direct or indirect damages resulting from the use of the Services by the user.
2. Users are responsible for the final decisions and actions based on the information provided by the Services.
3. The Counselling Room does not guarantee that all information, articles, images, etc., on this site are free from viruses or other harmful elements, or that the site is free from unauthorised access by third parties.
Article 3: Prohibition of Reproduction of Information
1. All copyrights of the data, articles, images, etc., on this site belong to the Counselling Room and the creators of such images, etc. Viewers cannot reproduce images, data, and programs from this site to other sites, magazines, advertisements, etc., without permission, except in special circumstances determined by the Counselling Room. However, viewers may reproduce and quote articles and texts on this site on their websites with permission from the Counselling Room.
2. In case of unauthorised reproduction of information on this site, the Counselling Room will take actions based on copyright laws (such as warnings, prosecution, claims for damages, injunctions, measures for the restoration of honour, etc.) against the violator.
Article 4: Compensation for Damages
1. Users are responsible for compensating for any damages caused to third parties, including the Counselling Room and its business partners, due to violations of these terms and conditions, site regulations, guidelines, and laws, and will exempt the Counselling Room and its business partners from any liability.
2. Users who cause damage to the Counselling Room, its business partners, or third parties in violation of Article 3 are liable to compensate for all damages suffered by the Counselling Room, its business partners, other users, or third parties.
Article 5: Temporary Suspension of Services
The Counselling Room may temporarily suspend the provision of services without prior notice to users for the following reasons. The Counselling Room is not liable for any loss or damage directly or indirectly incurred by users or third parties due to the suspension of services, regardless of the nature or manner of the loss or damage.
(1) If the applicant does not exist.
(2) If contact cannot be made by phone or email.
(3) If services cannot be provided due to natural disasters.
(4) If users violate these terms and conditions.
(5) If there are operational or business difficulties in providing the services.
(6) If past violations are discovered.
If the Counselling Room determines that the continuous provision of services is difficult due to the reasons in the preceding paragraph, it may terminate the services without notifying the users.
Article 6: Jurisdiction
In the event of a dispute between the users and the Counselling Room related to these terms and conditions, both parties shall negotiate in good faith to resolve the matter.
If the dispute cannot be resolved through negotiation, the local court shall have exclusive jurisdiction as the court of first instance.
The governing law of these terms and conditions is Japanese law for online services and Australian law for face-to-face services.
Article 7: User Conduct
Users are responsible for the content of the communications they send and receive using this site.
Users agree that additional communication costs may be incurred due to their internet connection environment and bear all such costs.
Users acknowledge that they may not be able to view or use some parts of the Services due to their internet connection environment.
If users suffer any disadvantages as a result of receiving counselling services, the Counselling Room is not responsible, provided that the information was used based on the users’ free judgment and will, except in cases of false or malicious information.
Article 8: Changes to These Terms and Conditions
The Counselling Room may revise these terms and conditions as necessary without prior notice due to its circumstances. Users are responsible for checking the content of these terms and conditions each time they use this site. If users use the Services after the revision, they are deemed to have agreed to the revised terms and conditions. The Counselling Room is not liable for any damages, directly or indirectly, incurred by users or third parties due to not checking this page, regardless of the nature or manner of the damage.
Article 9: Cancellation Policy
Cancellations due to users’ circumstances on the day before or the day of the appointment will be charged 100% of the counselling fee.
Article 10: Refunds
Due to the nature of the Services, refunds are not possible.
Article 11: Prohibited Conduct
When using the Services, users must not engage in any of the following conduct:
Defaming or slandering the counsellor.
Attempting to obtain personal information about the counsellor.
Stalking the counsellor or engaging in other harmful conduct against the counsellor’s body, life, freedom, honour, or property.
Engaging in profit-making activities such as selling goods to the counsellor.
Engaging in religious activities or soliciting the counsellor to join specific organisations.
Infringing on the counsellor’s privacy, portrait rights, or other rights.
Damaging the credibility or honour of the counsellor or the service site.
Illegally accessing the equipment of the Counselling Room, altering or deleting information related to the Services, or programming computer viruses.
Conduct that violates laws or public order and morals.
Meeting the counsellor personally.
Article 12: Miscellaneous
The Services provided by the Counselling Room are not medical acts. Therefore, the Counselling Room does not provide diagnoses, medical examinations, or treatments, and medical insurance does not apply.
The Services provided by the Counselling Room aim to resolve users’ psychological issues from a psychological standpoint but do not guarantee complete resolution of psychological problems.
The use of the Services by minors requires a consent form from a guardian. If there is no consent form, the Services cannot be provided. Even if there is a consent form, the Counselling Room may refuse to provide the Services if it deems it difficult to do so.
